This reservation must be submitted for review 2 weeks prior to your intended use dates.
Reservation Term is for one week on a first come first served basis. An additional week may be requested if the docks are available.
Maximum overall vessel length not to exceed 25' (feet) in total length.
Boats, trailers, kayaks, paddle boards, or other water crafts can not be stored on Model Village Unit One Property. The person reserving the use of the dock accepts all responsibilities for its use and agrees to hold Model Village Unit One, Inc. harmless.
**Your reservation is NOT approved or confirmed until you receive a response identifying which dock you have been assigned. Depending on availability, you will be assigned dock number # 4 or dock #10. Please review the map for reference.**
Termination: Termination by Authorized Reserver or Condo owner. Reserver or Condo owner shall give the Model Village Unit One, Inc. 48 Hours written notice prior to departure: Failure to do so will result in the Model Village Unit One, Inc having the option of assigning the said dock to another Condo owner or renter.
- For cause. Model Village Unit One, Inc. may terminate this agreement for cause if the user violates any terms or conditions of this agreement, Model Village Rules and or regulations or its incorporated obligations. If the Owners/Reserver violates any of the terms and conditions in this agreement. Model Village Unit One, Inc. shall have the option of terminating this agreement immediately written upon written or verbal notice to Owner/Reserver. Reserver must remove their boat from the slip prior to the end of the day of the notice period.
- Not for cause. Model Village Unit One, Inc. retains the right to terminate this agreement without cause, at anytime, upon 24 hour written notice to the Reserver. In such cases, any prepaid fees, charges, or expenses shall be prorated and any surplus returned to the Reserver, and Reserver shall remove their boat by the end of the date of notification. Nothing in this paragraph 6 shall waive any other right of Model Village Unit One, Inc. under this agreement, at law, equity or admiralty.
Removal: If the Owner/Reserver fails to remove their boat and equipment from the reserved slip before the termination or expiration of this agreement and after proper notice of same, Model Village Unit One, Inc. shall be entitled to:
- Remove the vessel and store or re-dock the vessel at any location in any commercially reasonable manner, all at the expense of the Condo Owner or Reserver.
- Failure to pay said fees will result in a lien being placed on the condominium owner.
- Locking the vessel in place until all fees and fines are brought current
- Charge the Vessel the then current transient rate per day for so long as the vessel remains in Model Village Unit One, Inc. slip until all the Owner/Reserver has paid any fees or charges applied are brought current
- Exercise any other right Model Village Unit One, Inc. shall have at law, admiralty or equity
- Any combination of any or all remedies set forth in this paragraph
Reserver shall not have the right to remove his boat from the rented slip or the location to which Model Village Unit One, Inc. has relocated the vessel herein under, until all costs and fees associated with this agreement have been paid in full. Reserver agrees that the Model Village Unit One, Inc. may look to the credit of the vessel for unpaid rent, dockage and other services provided to the vessel, and the Slip owner may use self help, the state, federal and maritime lien laws in pursuit of its rights to payment.
Sublease: Reserver agrees not to transfer, sublet, assign, of permit the use of his slip by any other person or vessel than described above
Foul Weather Reserver: agrees that it is not relying in any way upon the skill or intervention of the Model Village Unit One, Inc. to protect the vessel should foul or dangerous weather threaten to damage, or damage the vessel. The Owner/Renter
agrees to hold Model Village Unit One, Inc. harmless, indemnify and defend them from any claims of any other owners of property or vessels at the Model Village Unit One, Inc. facility arising out of contact with the Owner/Renters Vessel, and further agrees to be responsible to Model Village Unit One, Inc. for damage to Model Village Unit One, Inc. facilities or property arising out of contact with Renter’s Vessel or any fuel or appurtenance the including, without limitation, dock damage, environmental fines, and all other liabilities.
agrees to hold Model Village Unit One, Inc. harmless, indemnify and defend them from any claims of any other owners of property or vessels at the Model Village Unit One, Inc. facility arising out of contact with the Owner/Renters Vessel, and further agrees to be responsible to Model Village Unit One, Inc. for damage to Model Village Unit One, Inc. facilities or property arising out of contact with Renter’s Vessel or any fuel or appurtenance the including, without limitation, dock damage, environmental fines, and all other liabilities.
Insurance Coverage: The Reserver must have a boat owners policy insurance policy with a minimum of $300,000.00 liability coverage naming Model Village Unit One, Inc. as co-insured for the entire time the vessel is at dock at the Model Village Unit One, Inc. and provide Model Village Unit One, Inc. with a copy of said coverage.
Entire Agreement: This agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and it may not be amended except in writing signed by both parties hereto.
Choice of Law and Forum: Any dispute arising hereunder shall be governed by the laws of the State of Florida supplemented by Federal Admiralty law, and any action to enforce this agreement must be brought exclusively in the courts of Collier County

Severability: In the event that any provision of this agreement should be held to be void, voidable or unenforceable, the remaining portions hereof shall remain in full force and effect.
Binding Nature: This agreement is binding upon and shall inure to the benefit of all parties hereto and their respective heirs, successors, and assigns. IN WITNESS WHEREOF, the parties hereto have executed this agreement on the date first set forth by submission of this form.
